Criminal cases have been filed against 200 illegal building owners by the Greater Hyderabad Municipal Corporation (GHMC). 135 builders in areas like Housing Board, Addagutta colony, Sardar Patel Nagar in Kukatpally municipal circle, 35 builders in Serilingampally area and 35 owners from LB Nagar circle are facing the criminal cases. The corporation found 200 more illegal structures in the city and has been proceeding to file criminal cases against them. About 111 illegal buildings have been identified in Secunderabad, Malkajgiri and Alwal circles.
The corporation even considered serious cases like illegal floors and buildings which were constructed without any permission from the corporation. Cases where the owners applied for Building Penalisation Scheme (BPS) and started construction have also been taken up. Most of such cases were found in Karmanghat in LB Nagar and Vivekananda Nagar colony, Addagutta colony and Eenadu colony in Kukatpally circles.
Until 2008, there was no provision to file cases against the builders involved in illegal constructions. However, a fine was imposed on them. It was only after the proposal of the Section 461(4) of the GHMC Act 2008 that the corporation has the right to prosecute the owners if there are deviations from the sanctioned plan, zoning regulations, master plan and building rules. With a proof of the charge, the builders can be jailed for a term up to three years or may be facing a penalty of 10 percent of land and building cost or both.
